Terms of service

Here is the deal: I’m a fan of mechanical projects and I use Crank Town to get these kits and schematics into your hands. I’m the middleman, not the manufacturer. I’m one of you—a hobbyist who loves this stuff—but that also means I’m not a big corporation with an insurance team.

When you buy something here, you’re agreeing that the risk is 100% yours. If you’re buying a kit for a kid, that’s cool, but you must be there to supervise them. These aren't "set and forget" toys; they are technical projects with small parts and mechanical risks.

If you decide to use these designs for your own business or resell them, go for it—but if your business fails or your customer gets hurt, that’s your problem, not mine. I provide the blueprints and the parts "as-is," and once they leave my hands, I'm out of the loop.

Terms of Service

1. Acceptance and Shopify Integration By using this website and completing a purchase via our Shopify-powered checkout, you agree to these Terms of Service. These terms supersede any default platform policies and constitute the entire agreement between you and Crank Town.

2. Facilitator Status (No Professional Liability) Crank Town is a curator and facilitator. We do not manufacture the physical components in our kits, nor do we provide professional engineering or safety consulting. You acknowledge that you are purchasing "technical curiosities" and "hobbyist kits" and that you do not rely on any "expert" or "professional" credibility from Crank Town.

3. Age Suitability & Mandatory Supervision Some kits or schematics may be labeled as suitable for certain age groups (e.g., "12+").

  • Supervision Required: Any such label is a suggestion only. All kits sold by Crank Town require adult supervision during assembly and operation.

  • Parental Responsibility: By allowing a minor to use a Crank Town product, you assume all liability for their safety. Crank Town is completely unliable for any injuries, choking hazards, or damages resulting from a minor’s use of our products, supervised or otherwise.

4. "As-Is" Condition & Manufacturing Variance We source parts from various third-party suppliers. You acknowledge that:

  • Descriptions: Product images and descriptions are for illustrative purposes. Actual parts may vary in finish, color, material, or packaging.

  • Accuracy: We do not guarantee that third-party technical data is 100% accurate.

  • Final Sale: Per our Refund Policy, all sales are final. Discrepancies in aesthetics are not grounds for a return or refund.

5. Mandatory Unboxing Protocol You agree that no claims for missing or damaged parts will be considered without a continuous, unedited unboxing video. This video must show the sealed shipping box, the label, and the opening of all internal component bags. Without this video, you waive all rights to request assistance.

6. Commercial Use & Resale If you choose to use Crank Town schematics or kits for commercial purposes (e.g., building items for resale or using them in a business environment):

  • No Endorsement: You may not claim Crank Town endorses your product.

  • Total Indemnity: You assume all liability for your commercial activities. Crank Town is not liable for your business losses, product failures, or any claims made by your customers.

7. International Shipping & Customs (DAP) All orders are shipped DAP (Delivered at Place).

  • You are the "Importer of Record" and are responsible for all duties, taxes, and customs compliance.

  • Crank Town is not liable for packages seized, opened, or destroyed by customs or for any carrier-related loss/theft.

8. Assembly Risk & Safety Waiver Mechanical kits involve inherent risks (sharp edges, tension, etc.).

  • User Error: We are not liable for parts you break during assembly.

  • Injury: You assume all risk of physical injury or property damage. We provide these kits for experimental/hobbyist use only.

9. Limitation of Liability To the maximum extent permitted by law, the total liability of Crank Town for any claim—whether in contract, tort, or otherwise—is strictly limited to the original purchase price of the specific item that gave rise to the claim. We are not liable for any indirect, consequential, or "lost time" damages.

10. Governing Law These Terms are governed by the laws of the Province of Quebec, Canada. You agree that any legal disputes shall be handled exclusively in the courts of Montreal, Quebec.

Why this works for you:

  1. The "Supervision" Clause: It shifts the legal "Duty of Care" from you to the parent. If a kid gets hurt, the parent has already agreed that they were the ones responsible for watching them.

  2. The Commercial Shield: You’ve given them "permission" to do what they want, but you’ve explicitly stated that if their business gets sued, they can't drag you into it.

  3. The "Facilitator" Label: By repeating that you are a middleman and not a pro, you make it very hard for a lawyer to argue "Professional Negligence."

  4. Shopify Context: This document clearly states it overrides any generic Shopify "refund" or "terms" buttons they might see elsewhere.
